1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and FRIONTECH ("Company," "we," "our," or "us") regarding your use of our website friontech.net and our technology services.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.
2. Description of Services
FRIONTECH provides comprehensive technology solutions including:
- Hosting Services: Web hosting, managed servers, SSL certificates, and monitoring
- Cloud Solutions: Infrastructure on AWS, Azure, and Google Cloud platforms
- IT Consulting: Strategic technology planning and digital transformation
- Custom Development: Web applications, APIs, and software solutions
- Email Marketing: Campaign management and automation workflows
- IT Procurement: Hardware and software procurement services
3. Eligibility and Account Registration
3.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use our services.

5.1 Uptime Commitment
We strive to maintain 99.9% uptime for our hosting services. Scheduled maintenance and force majeure events are excluded from uptime calculations.
5.2 Service Modifications
We reserve the right to modify, suspend, or discontinue services with reasonable notice. We will make commercially reasonable efforts to minimize service disruptions.
5.3 Maintenance
We may perform scheduled maintenance during off-peak hours. Emergency maintenance may be performed without prior notice when necessary for security or stability.
6. Payment Terms and Billing
6.1 Fees and Payment
You agree to pay all applicable fees as specified in your service agreement. Payments are due according to the billing cycle selected (monthly, quarterly, or annually).
6.2 Late Payments
Late payments may result in service suspension. A late fee may be applied to overdue accounts. Services will be restored upon payment of outstanding balances.
6.3 Refunds
Refunds are provided according to our refund policy as communicated at the time of service purchase. Custom development work is generally non-refundable once commenced.
6.4 Price Changes
We may change pricing with 30 days' notice. Existing customers will be notified of price changes affecting their current services.
7. Data and Content
7.1 Your Content
You retain ownership of content you upload or create using our services. You grant us a license to host, store, and process your content as necessary to provide services.
7.2 Content Responsibility
You are solely responsible for your content and must ensure it complies with applicable laws and these Terms. We reserve the right to remove content that violates our policies.
7.3 Backup and Data Loss
While we implement backup procedures, you are responsible for maintaining your own backups. We are not liable for data loss except as specified in your service agreement.
8. Intellectual Property
8.1 Our Intellectual Property
Our services, software, and website content are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.
8.2 Custom Development
For custom development projects, intellectual property ownership will be specified in the project agreement. Generally, you own the final deliverables while we retain rights to underlying frameworks and methodologies.
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Limitation of Liability
10.1 Service Limitations
Our services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
10.2 Liability Cap
Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount paid by you for services in the 12 months preceding the claim.
10.3 Excluded Damages
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.
11. Indemnification
You agree to indemnify and hold harmless FRIONTECH from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.
12. Termination
12.1 Termination by You
You may terminate your account at any time by providing written notice. You remain responsible for all charges incurred before termination.
12.2 Termination by Us
We may terminate or suspend your account for:
- Violation of these Terms
- Non-payment of fees
- Illegal or harmful activities
- Extended periods of inactivity
12.3 Effect of Termination
Upon termination, your access to services will cease, and we may delete your data after a reasonable retention period. You may request data export before termination.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Tanzania. Any disputes will be resolved in the courts of Tanzania.
13.2 Dispute Process
Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiations. If unsuccessful, disputes may be submitted to mediation or arbitration.
14. Force Majeure
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, network failures, or other force majeure events.
15. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any provision does not constitute a waiver of our rights.
